1. Operator, Scope and Legal Nature of the Agreement

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and:

regarding your access to and use of the mobile application Where Am I (“WAI”, “App”, “Service”).

By downloading, installing, accessing, or using the App in any manner, including passive or background use, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you must immediately discontinue use of the App.

These Terms apply to users located in the European Union (EU)/European Economic Area (EEA), the United Kingdom, and the United States.

2. Relationship with Apple

If you obtained the App through the Apple App Store:

Apple Inc. is not a contracting party to these Terms.
Apple bears no responsibility for the App, its content, or its operation.
Apple has no obligation to provide maintenance, support, or updates.
Apple is a third-party beneficiary of these Terms and may enforce them against you.
Any claims, disputes, damages, or liabilities arising from or relating to the App must be directed solely against the operator, not Apple.

3. Eligibility

The App is intended exclusively for individuals aged 18 years or older.
By using the App, you represent and warrant that you are at least 18 years old.
Use by minors, whether supervised or unsupervised, is strictly prohibited.

4. Description of the Service

WAI is a location-based informational and experiential application that provides AI-generated audio and text content related to places a user passes through.

The Service may include, without limitation:

Place names, population figures, and foundation dates
General historical, cultural, or geographic descriptions
Non-exhaustive references to attractions, events, dining, or accommodation
Temporary storage of visited locations for recap purposes

Explicit Exclusions and Clarifications

The App:

does not provide navigation, routing, turn-by-turn directions, or traffic guidance
does not assess road conditions, hazards, or safety
does not provide driving, riding, walking, or travel instructions

Any navigation, detours, or directions are handled entirely by third-party services, governed by their own terms and policies. The App is designed solely for informational, experiential, and entertainment purposes.

The operator strives to make the Service accessible and does not engage in unlawful discrimination as prohibited under applicable law.

5. No Emergency, Safety, or Critical Use

The App:

is not an emergency service;
is not designed for safety-critical, medical, rescue, or legal use;
must not be relied upon in situations requiring immediate action or professional judgment.

You acknowledge that reliance on the App in emergency or high-risk situations may result in harm, loss, or damage, for which the operator bears no responsibility. In all emergencies, you must contact local emergency services directly.

6. Safety, Driving Context & Assumption of Risk

6.1 General Acknowledgement of Inherent Risk

You expressly acknowledge that use of the App in driving or movement contexts inherently involves risks. These risks include, but are not limited to, distraction, divided attention, delayed reaction time, misinterpretation of information, or reduced situational awareness.

Such risks may arise:

even when the App functions correctly;
even when content is accurate;
even when interaction is minimal or audio-only;
even when the App is used passively or in the background.

6.2 Driving and Riding Context

When using the App while driving or riding in any vehicle, you expressly acknowledge and agree that:

You alone determine when, how, and whether to interact with the App.
You remain solely responsible for the safe operation of your vehicle at all times.
Traffic laws, road conditions, weather, visibility, and vehicle status always take precedence over App use.
The operator has no ability to detect, control, or restrict your driving behavior or App interaction.

You expressly and knowingly assume all risks associated with distraction or divided attention, whether foreseeable or unforeseeable.

6.3 Passenger Use

If you are a passenger, you acknowledge that your use of the App must not interfere with the driver or vehicle operation. Any interference is solely your responsibility.

7. AI-Generated Content Disclaimer and Non-Reliance

The App uses artificial intelligence technologies, including third-party providers, to generate content.

You expressly acknowledge that:

AI-generated content may be inaccurate, incomplete, outdated, generalized, misleading, or incorrect.
Content may be synthesized, summarized, dramatized, or fictionalized.
Content is generated automatically and is not reviewed, verified, or curated by humans.

The App does not establish a duty of care, advisory relationship, or reliance relationship of any kind.

You agree that:

No AI-generated content constitutes advice, guidance, instruction, or recommendation.
You will not rely on App content for decisions involving safety, legality, travel planning, financial expenditure, or personal well-being.
The operator has no obligation to correct errors, update information, or notify users of inaccuracies.

8. Location Data, Positioning & Technical Limitations

The App requires continuous precise location access to operate.

You acknowledge that:

Location data may be inaccurate or delayed due to GPS limitations, tunnels, buildings, terrain, device sensors, operating system behavior, or signal loss.
Content may be triggered for approximate, adjacent, or incorrect locations.
Server latency, background execution limits, or connectivity issues may affect timing or delivery.

Content delivery is based on probabilistic signals and system conditions. Any actions you take based on perceived location, timing, or relevance of content are undertaken independently and at your sole discretion, not as a result of instruction or direction by the App.

The processing of personal data is further governed by the Privacy Policy, which forms an integral part of these Terms

9. User Accounts (Present and Future)

No account is required at initial launch.
Account-based features may be introduced later.
Features may change, degrade, or be removed without notice.

The operator has no obligation to maintain backward compatibility or feature continuity.

10. User Content & License

“User Content” includes saved journeys and AI-generated stories associated with your activity.

You retain ownership of your User Content.

You grant the operator a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, process, display, reproduce, adapt, and analyze User Content for the operation and improvement of the Service, including anonymized and aggregated use.

The operator may moderate, restrict, or remove User Content at its sole discretion.

11. Prohibited Use

You agree not to:

reverse engineer, decompile, or attempt to extract source code;
scrape, mine, or commercially exploit App content;
use the App in an unsafe, unlawful, or abusive manner;
bypass safeguards or interfere with service integrity;
use the App for commercial purposes without authorization.

12. Subscriptions & Payments

The App operates on a freemium model with optional monthly premium subscription.
Payments are processed exclusively via Apple In-App Purchases.
Subscriptions auto-renew unless canceled through Apple.
All sales are final; refunds are handled solely by Apple.

By payment or subscriptions, you acknowledge that performance of the Service begins immediately upon purchase. Where permitted by applicable law, you understand that this may result in the loss of statutory withdrawal rights once payment and subscription has commenced.

Pricing, features, and availability may change at any time.

13. Beta / TestFlight Disclaimer

During beta testing:

Features may be incomplete, unstable, or experimental.
Functionality may change or be removed without notice.
Data loss, inconsistency, or corruption may occur.
No service availability or continuity is guaranteed.

14. Intellectual Property

All rights in the App, including software, branding, structure, and presentation, remain the exclusive property of the operator. You receive a limited, non-transferable, non-commercial license for personal use only.

15. Third-Party Services

The App may rely on third-party services, APIs, or platforms.

The operator:

does not control such services;
does not guarantee availability, accuracy, or continuity;
bears no responsibility for errors, interruptions, changes, or cascading failures arising from third-party services.

16. Suspension & Termination

The operator may suspend or terminate access at any time:

for violations of these Terms;
to comply with law;
to protect the Service, users, or third parties.

No obligation exists to continue providing the Service.

17. Limitation of Liability

17.1 EU / UK Users

Nothing limits liability where prohibited by mandatory consumer law. Otherwise, liability is limited to damages caused intentionally or by gross negligence.

17.2 US Users – Assumption of Risk

You expressly assume all risks arising from use of the App. To the fullest extent permitted by law, the operator disclaims liability for personal injury, accidents, property damage, or consequential losses. Total liability is limited to amounts paid by you in the last 12 months.

18. Indemnification

You agree to indemnify and hold harmless the operator from claims, damages, or losses arising from your misuse of the App, violation of these Terms, or violation of law or third-party rights.

19. Force Majeure

The operator is not liable for failure or delay caused by events beyond reasonable control.

20. Severability, Assignment, Entire Agreement

Invalid provisions do not affect remaining Terms.
You may not assign rights without consent.
These Terms constitute the entire agreement between the parties.

21. Governing Law & Dispute Resolution

Governing law: Austria
Jurisdiction: Vienna courts
Parties agree to attempt amicable resolution before litigation.

22. Language

Multiple languages may be available. In case of conflict, the English version prevails.
